Terms of Service

Welcome to My Maternal Mind. These Terms of Service (“Terms”) govern your use of the My Maternal Mind mobile application (the “App”) operated by My Maternal Mind (“we”, “us”, “our”). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Description of Service

My Maternal Mind is an AI-powered maternal wellness application that provides:

  • Personalized meditation sessions generated using artificial intelligence, tailored to your maternal stage (trying to conceive, pregnant, or postpartum).
  • Guided journaling prompts and a daily reflection journal.
  • Daily affirmations personalized to your stage and goals.
  • Progress tracking including meditation streaks, achievements, and mindful minutes.

3. Account Registration

To use the App, you must create an account using either email registration or Apple Sign-In. By creating an account, you represent that:

  • You are at least 18 years of age.
  • The information you provide is accurate and complete.
  • You will maintain the accuracy of your account information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

The App offers premium features through paid subscription plans managed via Apple In-App Purchase and RevenueCat:

  • Free trial: New subscribers receive a 3-day free trial. You will not be charged during the trial period.
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the end of the current period.
  • Cancellation: You may cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period.
  • Price changes: We reserve the right to change subscription pricing. Existing subscribers will be notified in advance of any price changes.

All payments are processed by Apple. We do not directly collect or store your payment information. For refund requests, please contact Apple Support.

5. User Content

You retain ownership of all content you create within the App, including journal entries, saved affirmations, and profile information (“User Content”).

By using the App, you grant us a limited, non-exclusive, non-transferable license to use your User Content solely for the purpose of providing and improving the App's services. This includes using anonymized thematic summaries from journal entries to personalize meditation content. We will never share your raw journal text with third parties.

6. AI-Generated Content

The App uses artificial intelligence to generate meditations, affirmations, and wellness insights. You acknowledge and agree that:

  • AI-generated content is intended for general wellness purposes only and does not constitute professional medical, psychological, or therapeutic advice.
  • AI-generated content is not a substitute for professional medical or mental health care. If you are experiencing a medical or mental health emergency, contact your healthcare provider or emergency services immediately.
  • AI-generated content may vary in quality and relevance. We strive for accuracy but cannot guarantee that all generated content will be appropriate for your individual circumstances.

7. Prohibited Uses

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App.
  • Share your account credentials with third parties or allow others to access your account.
  • Use the App for any unlawful, fraudulent, or unauthorized purpose.
  • Upload or transmit harmful, offensive, or abusive content through any feature of the App.
  • Interfere with or disrupt the App's services, servers, or networks.
  • Attempt to bypass any security measures or access restrictions.
  • Use the App to harass, stalk, or intimidate any person.
  • Reproduce, distribute, or publicly display AI-generated meditation content for commercial purposes without our written consent.

8. Intellectual Property

The App, including its design, code, branding, visual elements, AI-generated content templates, and underlying technology, is the property of My Maternal Mind and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

User Content remains your property, subject to the limited license described in Section 5.

9. Disclaimers

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure. We do not provide medical advice and make no guarantees regarding specific health or wellness outcomes from using the App.

The App is a wellness tool and is not intended to diagnose, treat, cure, or prevent any medical condition. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY MATERNAL MIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account and access to the App at our sole discretion if you violate these Terms or engage in conduct that we determine to be harmful to other users, us, or third parties.

You may delete your account at any time via Profile > Delete Account. Upon account deletion, all your personal data will be permanently removed from our servers as described in our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date at the top of this page. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
